1Introduction
Welcome to Moko Online, accessible at mokoonline.in. Moko Online is an online local business directory and listing platform that connects vendors with potential customers across India.
By accessing or using our website, registering as a vendor, or listing any product or service on our Platform, you agree to comply with and be bound by these Terms & Conditions. If you do not agree, please discontinue use immediately.
Important: These Terms & Conditions constitute a legally binding agreement between you (the Vendor or User) and Moko Online. Please read them carefully before registering or making any payment.
2Definitions
- "Moko Online" / "Marketplace" / "Platform" refers to the online business directory operated at mokoonline.in and all its related services.
- "Vendor" / "Seller" refers to any individual or business entity that lists products, services, or a business profile on the Platform.
- "Buyer" / "User" / "Customer" refers to any individual or entity that browses the Platform or contacts vendors through it.
- "Listing" refers to any business profile, product detail, service description, or media uploaded by a Vendor.
- "Registration Fee" refers to the monthly subscription fee of ₹0 (inclusive of applicable taxes) charged to Vendors.
- "KYC Documents" refers to government-issued identity proof documents submitted by Vendors (Aadhaar, PAN, Driving Licence, or Passport).
3Vendor Eligibility & Obligations
Eligibility: To register as a Vendor, you must:
- Be at least 18 years of age and legally capable of entering into binding contracts under Indian law.
- Be a legally operating business or individual providing lawful products or services.
- Hold valid GST registration where mandatorily applicable under the GST Act, 2017.
- Submit valid government-issued KYC documentation at the time of registration.
- Provide accurate, truthful, and complete information during and after registration.
Ongoing Obligations:
- Maintain accurate and current information on your listing at all times.
- Ensure all products and services comply with applicable Indian laws and consumer protection regulations.
- Respond to customer enquiries in a timely and professional manner.
- Honor all commitments, representations, and pricing disclosed on your listing.
- Not engage in any fraudulent, deceptive, or misleading practices.
- Not list prohibited items including counterfeit goods, illegal substances, weapons, or any products restricted under Indian law.
KYC Compliance: Providing false, forged, or misrepresented identity documents is a criminal offence under Indian law. Any Vendor found submitting fraudulent documents will be permanently banned and may be reported to appropriate authorities.
4Product & Service Listings
- All product descriptions, service details, images, and pricing must be accurate, truthful, and not misleading to customers.
- Vendors must ensure listed products and services comply with applicable safety, labelling, and consumer protection laws including the Consumer Protection Act, 2019.
- Vendors are solely responsible for the accuracy and completeness of their listing content.
- Moko Online reserves the right to remove, modify, suspend, or reject any listing that violates these Terms — without prior notice and without any obligation to refund listing fees.
- Moko Online does not verify, endorse, or guarantee the accuracy of any information provided by Vendors in their listings.
5Payments & Billing
- The Vendor listing fee is ₹0 per month, billed monthly from the date of registration.
- Payments are processed through Razorpay (PCI DSS-compliant). Vendors may pay via UPI, credit card, debit card, net banking, wallets, or EMI.
- Monthly billing is automatic and charged on the same date each month.
- Non-payment will result in immediate deactivation of the Vendor's listing without prior notice.
- Moko Online charges a platform listing fee only — no commission is charged on vendor transactions.
- Vendors are solely responsible for paying all applicable taxes including GST and TDS on their own business earnings.
Non-Refundable Policy: All payments made to Moko Online are strictly non-refundable under all circumstances. This includes early cancellation, voluntary deactivation, dissatisfaction with the service, account suspension, or any other reason. By completing payment, you irrevocably waive any right to a refund of fees paid to Moko Online.
Moko Online reserves the right to revise the monthly listing fee with at least 30 days advance notice to registered Vendors.
6Order Fulfilment & Delivery
- Moko Online is a listing and discovery platform only. We do not process, manage, or facilitate any transactions, orders, or deliveries between Vendors and Buyers.
- All orders, transactions, and communications between Vendors and Buyers take place entirely outside the Moko Online platform.
- Vendors are solely responsible for fulfilling orders, meeting delivery timelines, and ensuring product/service quality.
- Any risk of loss, damage, or non-delivery during transit lies entirely with the Vendor.
- Moko Online has no role in, and accepts no responsibility for, any transaction between a Vendor and a Buyer.
- Buyers are advised to independently verify Vendor credentials and service terms before engaging in any transaction.
7Returns, Refunds & Cancellations
Moko Online's Position: Moko Online is strictly a business listing and discovery platform. We are NOT a seller, marketplace operator, or party to any transaction. Moko Online has absolutely no involvement in, and accepts no responsibility for, any return, refund, replacement, cancellation, or dispute arising from any transaction between a Vendor and a Buyer.
Vendor Responsibility:
- All return and refund requests from Buyers must be addressed directly by the Vendor. Moko Online will not mediate, arbitrate, or intervene in any such requests under any circumstances.
- Vendors are solely responsible for establishing, communicating, and honouring their own return and refund policies in compliance with the Consumer Protection Act, 2019.
- Any refund issued to a Buyer is entirely at the Vendor's discretion and expense. Moko Online bears no financial responsibility.
- Vendors must clearly communicate their return/refund policy to customers at the time of sale.
- Cancellation of orders between Vendors and Buyers is to be resolved entirely between them. Moko Online has no authority to cancel or reverse any vendor-buyer transaction.
📦 Return Policy — Information for Buyers
Moko Online is a business directory only. We connect you with Moko Partners but are not involved in any purchases, deliveries, or transactions. For any return, refund, or complaint:
- Contact the Vendor directly using the phone number or WhatsApp shown on their listing.
- All return and refund decisions are made entirely by the Vendor — not by Moko Online.
- Moko Online has no authority to compel a Vendor to issue a refund or accept a return.
- Moko Online is not liable for any loss, damage, or dissatisfaction from a transaction with a listed Vendor.
- To report a Vendor for fraudulent conduct, contact us through mokoonline.in and we will review the listing.
8Data Protection & Privacy
- Moko Online collects and processes personal data in compliance with the Information Technology Act, 2000 and applicable data protection regulations in India.
- KYC documents are stored with encryption and used only for identity verification. They will not be publicly displayed or shared with third parties without legal obligation.
- Vendors must not misuse Buyer contact information for unsolicited marketing, spam, or any purpose beyond responding to the Buyer's specific enquiry.
- Buyers consent to their contact information being shared with the Vendor they enquire about, solely for the purpose of that enquiry.
- By registering, Vendors consent to receiving platform-related communications via email, SMS, and WhatsApp.
9Liability & Indemnification
Platform Role: Moko Online acts solely as an intermediary listing platform. Moko Online is NOT the seller, supplier, or service provider of any products or services listed by Vendors.
Moko Online shall not be held liable for:
- Any damaged, defective, counterfeit, unsafe, or non-compliant products sold or supplied by any Vendor.
- Any services that are incomplete, poor quality, delayed, or not as described by any Vendor.
- Any financial loss, physical injury, or any other harm — direct, indirect, incidental, consequential, or punitive — arising from any transaction between a Vendor and a Buyer.
- Any failure by a Vendor to honour commitments, deliver products, or issue refunds.
- Any inaccuracy or misleading information in a Vendor's listing.
- Any interruption, unavailability, or technical failure of the Platform.
Vendor Indemnification: Each Vendor agrees to fully indemnify, defend, and hold harmless Moko Online, its owners, directors, employees, and agents from any and all claims, damages, losses, costs, and expenses (including legal fees) arising from:
- The Vendor's products, services, conduct, or omissions.
- Any breach by the Vendor of these Terms & Conditions.
- Any violation of applicable laws or third-party rights by the Vendor.
- Any claim by a Buyer or third party arising from a transaction with the Vendor.
10Governing Law & Compliance
- These Terms are governed by the laws of the Republic of India.
- Any dispute arising from these Terms or the Platform shall be subject to the exclusive jurisdiction of competent courts in India.
- All Moko Partners and Buyers must comply with the Consumer Protection (E-Commerce) Rules, 2020 to the extent applicable.
- Vendors must comply with all applicable laws including the Consumer Protection Act 2019, GST laws, and all laws governing their specific business activities.
Legal Compliance Notice: These terms are governed by Indian law including the Information Technology Act 2000, Consumer Protection Act 2019, and Consumer Protection (E-Commerce) Rules 2020.
11Platform Rights & Termination
- Moko Online reserves the right to suspend or permanently terminate any Vendor account at any time for violation of these Terms or applicable law — without refund of fees paid.
- Vendors may cancel their listing through the moksshmeendiratta@gmail.com. Cancellation takes effect at end of the current billing cycle. No refund will be issued for remaining days of a paid period.
- Moko Online may modify, update, or discontinue any feature of the Platform at its sole discretion without liability.
- Moko Online reserves the right to reject any registration application without providing a reason.
12Amendments
- Moko Online reserves the right to amend these Terms at any time.
- Material changes will be communicated to registered Vendors at least 15 days before taking effect via email or platform notification.
- Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
